Nursing Home Abuse

Kara Murphy, a certified Nurse Aide at the Atrium in Quincy was charged and sentenced for assaulting 4 elderly resident at the Atrium. Amoung the charges is a criminal count that she violated State Laws M.G.L.ch. 265 section 38 and MGL c 265 s.13K which prohibit senior citizen abuse in nursing homes.

Murphy listened at her arraignment as the prosecutor described how she assaulted four patients at the Quincy Atrium ( a Benchmark Facility), an assisted living center in Quincy. Her right to work in residential facilities has been suspended, and she was fired by the Atrium after an investigation. The accusations include punching and slapping one elder victim represented by our office, jumping up and down on the legs of another resident in a wheelchair, violently pushing a resident down and then forcing excessive water down her throat, and threatening to make a resident eat their own feces.

Update: On March 30, 2011, in Quincy District Court, Murphy pled guilty to several counts of Assault of Elders. The District Attorney asked that Murphy be sentenced to 2.5 years jail. The Defense asked for time served on house arrest.

The Judge explained in court the seriousness of crimes, and said that jail time is a very reasonable expectation in this case; he explained what pleading guilty means. Sentence finally handed down was 1 more year house arrest, anger management counseling, and a prohibition from work with elderly or children until probation is up.
